Warranty periods

Since January 1, 2002, new terms of warranty apply to commercial trade in used vehicles. The sale of a used vehicles by the dealer to a private individual is subject to a warranty period of two years. This can be limited contractually between dealer and customer for one year. What is omitted, however, is the exclusion of liability by the terms and conditions.

Also new is the reversal of the burden of proof in the first six months from the date of the transfer of risk. The used vehicle dealer or seller acting as a commercial person must prove that the deficiency during that period was not already present at the time of sale.
