Here are some hints:

If the seller is aware of previous damage and minor damage is excluded, he must explicitly state it. An accident, whether by him or the previous owner, must not be concealed. As a rule, it is difficult for the seller to prove that he was aware of any damage if the accident did not occur during the period of his possession.
In the case law, commercial car dealers are required to carry out an examination for accident damage, which leads to a lack of concealment, even if the seller is not aware of it. The used car dealer is obliged to perform a coating thickness measurement to determine previous accident damage. If he fails to comply with this obligation, the buyer can assert claims for defects, even if the seller has assured in the purchase contract that he is not aware of any previous damage.
Anyone who buys a used car from a private person, should expressly assure the freedom of accident. According to the case law, the pre-formulated declaration "the car is accident-free" does not cover any previous damage from the previous owner's time and no minor damage that the next seller does not know. For private sellers do not have sufficient knowledge and options to determine whether a car has already suffered damage to a previous owner.
